Idaho Cannabis History The use of cannabis is still fully illegal in Idaho, and possession of small amounts is considered a misdemeanor.  The only exception is CBD with 0% THC, which is lower than the 0.3% THC threshold allowed by federal law. In 2015, a bill to legalize CBD oil was passed by both houses of the Idaho Legislature, but was then vetoed by former governor Butch Otter.
